This Privacy Notice explains how LightSense™ Technologies ("we", "us", or "our") look after your personal data when you visit the LightSense™ Technologies website (“Website”) and tells you about your privacy rights and how the law protects you. It also describes your data protection rights, including a right to object to some of the processing which LightSense™ Technologies carries out. More information about your rights, and how to exercise them, is set out in the following.

1.1 PURPOSE OF THIS PRIVACY NOTICE
The Privacy Notice applies to you if you are a LightSense™ Technologies client, but it also applies if you are simply visiting our Website, interacting with us on social media, writing us an email, subscribing to our newsletter, or participating in one of our events.
We also may provide you with additional information when we collect personal data, where we feel it would be helpful to provide relevant and timely information.
When you visit our Website, or otherwise interact with us, LightSense™ Technologies may collect, use, store, and transfer different kinds of personal data about you. We collect most of this information from you directly. For example, data is collected from forms completed by you on our Website; obtained from your passport or other identity documents; from correspondence with you; or through interviews, meetings, or interactions with us on social media. We also collect some information about you from other people or organisations: we collect information from your doctor or other medical teams if necessary before we carry out any tattoo removal procedure, as well as from publicly available sources, such as search engines.

Where we process personal data on this basis, then – as required by data protection law – we have carried out a balancing test to document our interests, to consider what the impact of the processing will be on individuals, and to determine whether individuals’ interests outweigh our interests in the processing taking place. We may provide you with more specific notices for some of the processing described above and, if we require your consent, we will ask for this at the time we collect your personal data.
We provide you with an opportunity to express your preferences with respect to receiving marketing communications from us, and for us to share your personal data with trusted partners for their direct marketing purposes. If you wish to update these preferences, you can submit a request by contacting us using the contact details in Section 10. To opt out of receiving our email marketing communications, you can also follow the 'unsubscribe' instructions provided in any messages you receive from us.
We will only share personal data where doing so is permitted under data protection law. If this is the case, we may share your personal data with the following parties:
LightSense™ Technologies operates around the world. Therefore, we may share your personal data with our employees or other partners outside of the European Economic Area (“EEA”), but only when doing so is necessary for the purposes mentioned in this Privacy Notice. In the event that personal data is otherwise transferred outside of the UK or the EEA to an organisation in a country that is not subject to an adequacy decision by the EU Commission or considered adequate as determined by applicable data protection laws, we will take steps to ensure your personal information is adequately protected (e.g. by way EU Commission approved Standard Contractual Clauses, an appropriate Privacy Shield certification, a vendor's Processor Binding Corporate Rules or by relying on such other data transfer mechanisms as available under applicable data protection laws). A copy of the relevant mechanism can be obtained for your review on request by using the contact details below.
We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting, or reporting requirements. Generally, your personal data will be kept for 6 years after your tattoo removal procedure or otherwise from your last interaction with us. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe that we may need to enforce our legal rights (for example, a lawsuit against us).
To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data, and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

You have the right to ask LightSense™ Technologies for a copy of your personal data; to correct or delete your personal data; restrict the processing of your personal data; and to obtain the personal data you provide in a structured, machine-readable format. In addition, you can object to the processing of your personal data in some circumstances (in particular, where we do not have to process the data to meet a contractual or other legal requirement). Where we have asked for your consent, you may withdraw consent at any time. If you ask us to withdraw your consent to us processing your data, this will not affect any processing that has already taken place at that time.
These rights may be limited, for example, if fulfilling your request would reveal personal data about another person, if you ask us to delete information that we are required by law or have compelling legitimate interests to keep. If you have unresolved concerns, you have the right to complain to a data protection authority. In the UK, this will be the Information Commissioner.

9.2 CHANGES TO THE PRIVACY NOTICE
We keep our Privacy Notice under regular review. Any changes we make to this Privacy Notice in the future will be uploaded to the Website. We will provide you with a new privacy notice when we make any substantial changes. We may also notify you in other ways from time to time about the processing of your personal data.
